Terms of use

These terms are an agreement between you and TrueNorth Analytics Pty Ltd (ABN 24 726 502 584), which operates VivaReady ("we", "us", "our"). They apply whenever you use VivaReady at vivaready.com.au, including the website, practice stations, reports and emails.

By ticking the box to agree, creating an account, or using VivaReady, you accept these terms and our Privacy policy. If you don't agree, please don't use the service.

1. Who can use VivaReady

• You must be at least 18 years old.
• VivaReady is designed for doctors, medical students and other health professionals preparing for exams and interviews.
• You must give accurate details when you sign up and keep them up to date.

2. What VivaReady is — and what it isn't

VivaReady is an educational practice tool. Stations are fictional scenarios written to help you rehearse for oral and clinical exams.

• It is not clinical advice and must never be used to make decisions about real patients. Always follow current local guidelines, your organisation's policies and your own clinical judgement.
• Using VivaReady does not create a doctor–patient relationship, a supervisory relationship, or any professional relationship with us or our reviewers.
• Content may not reflect the latest guidelines or your local practice, and may contain errors. Check anything clinical against authoritative, current sources.
• Independent practice platform. Not affiliated with, or endorsed by, any college or examining body. Exam names are used only to describe what you can practise for.
• We don't guarantee any exam result. Practice scores, bands, readiness and mock outcomes are estimates for learning, not official results, and they don't predict how you'll do on the day.

3. AI and draft content

VivaReady uses AI to run the examiner, transcribe and tidy spoken answers, mark answers, answer tutor questions and help draft content. AI output can be inaccurate, incomplete or inconsistent.

• Content that a clinician hasn't reviewed is labelled "Draft — not clinically reviewed". Treat it with extra care.
• If a score looks wrong, ask for a review from your report. A person will look at it.
• You're responsible for how you use any content or feedback.

4. Your account

• Keep your password and sign-in codes secret, and tell us straight away if you think someone else has used your account.
• Your account is for you alone. Don't share it or let others use it.
• You're responsible for activity on your account unless it happened because of our failure to take reasonable care.

5. Acceptable use

You agree not to:

• enter information that could identify a real patient, or anyone else's personal information without their permission;
• copy, scrape, download in bulk, republish, sell or share stations, rubrics, marking points, frameworks or other content, or use them to build a competing product;
• use our content or outputs to train or improve AI models;
• try to get around security, access other people's data, probe or overload the service, or reverse engineer it except as the law allows;
• upload anything unlawful, harmful, misleading or that infringes someone else's rights;
• record other people through the service without their consent;
• use VivaReady in a way that breaks any law, college rule or exam regulation (for example, using it during a real exam).

6. Your content

You own the answers, notes and recordings you create ("your content"). You give us a non-exclusive, royalty-free licence to store, copy, process and display your content so we can provide VivaReady to you, and to use de-identified samples to check and improve marking and content. This licence ends when your content is deleted, except for de-identified samples that can no longer identify you.

If you send us feedback or suggestions, we may use them freely without owing you anything.

You're responsible for your content, and you confirm you have the right to give us this licence.

7. Our content

VivaReady, including stations, rubrics, frameworks, guides, software, design and branding, belongs to us or our licensors and is protected by intellectual property law. We give you a personal, non-transferable, revocable licence to use it for your own exam preparation while you have an account. All other rights are reserved.

8. Fees

VivaReady is free during early access. If we introduce paid plans, prices and what's included will be shown clearly before you buy, and you'll never be charged without agreeing first. Any paid plan will have its own purchase terms, which will sit alongside these.

9. Emails

We'll send account emails (such as sign-up confirmation and password-reset codes) and service emails such as study reminders, weekly progress and review notices. You can switch service emails off in Settings or from the link in each email. We'll only send news and promotions if you opt in.

10. Third-party services

VivaReady relies on third-party providers (listed in our Privacy policy), and your browser's own speech service if you use it. We're not responsible for services we don't control, but we choose providers carefully.

11. Availability and changes to the service

We work hard to keep VivaReady running, but it's provided as it is and as available. We may change, pause or retire features, stations or exam packs, and there may be interruptions for maintenance or reasons beyond our control. We'll try to give notice of significant changes.

12. Suspension and ending your account

You can stop using VivaReady at any time and delete your account in Settings. We may suspend or close your account, or remove content, if you breach these terms, if we're required to by law, or to protect other users or the service. Where it's reasonable, we'll tell you why first. Sections 6, 7, 13, 14, 16 and 17 continue after your account ends.

13. Australian Consumer Law and our liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that can't be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

To the extent the law allows:

• we don't give any warranty that isn't set out in these terms;
• we aren't liable for any indirect or consequential loss, or for loss arising from exam outcomes, decisions about patients, or reliance on content or scores in place of your own judgement;
• where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to supplying the services again or paying the cost of having them supplied again; and
• our total liability to you for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and AUD $100.

These limits don't apply to liability that can't be limited by law, or to loss caused by our fraud, wilful misconduct or gross negligence.

14. Your responsibility to us

To the extent the law allows, you'll be responsible for loss we reasonably suffer because you entered a real patient's identifying information, or deliberately or seriously breached section 5. This is reduced to the extent we caused or contributed to the loss.

15. Changes to these terms

We may update these terms. If a change is material, we'll publish the new version with a new date and ask you to agree to it before you continue using VivaReady. If you don't agree, you can stop using the service and delete your account.

16. Disputes and governing law

If something goes wrong, please contact us first at viva@truenorthanalytics.com.au — most things can be fixed quickly. These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you're a consumer, you may also have rights to use the courts or tribunals where you live.

17. General

• These terms, together with our Privacy policy and any purchase terms, are the whole agreement between you and us about VivaReady.
• If part of these terms can't be enforced, the rest still applies.
• If we don't enforce a right straight away, we can still do so later.
• You can't transfer your rights under these terms. We may transfer ours as part of a sale or restructure of our business, and these terms will continue to protect you.
